Eligibility: The 2024 GREY GOOSE x Miami HEAT Digital Sweepstakes is open only to legal residents of the United States residing in the State of Florida, except within 75 miles of the city limits of Orlando (“Eligibility Area”) who are at least twenty-one (21) years old at the time of entry. Employees¬ of Arrowhead Promotion & Fulfillment Co., Inc. (“Administrator”), Bacardi U.S.A., Inc. (“Sponsor”), Miami Heat Limited Partnership, Basketball Properties, Ltd., the National Basketball Association (“NBA”) and its Member Teams, NBA Properties, Inc., NBA Media Ventures, LLC, Miami-Dade County, City of Miami, or any of their respective parent companies, affiliates, divisions, subsidiaries, suppliers, distributors, or any other alcohol beverage company, their respective distributors, wholesalers, retailers (including bartenders/staff), or licensees, as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter. Void outside Eligibility Area and where prohibited. Winning a prize is contingent upon fulfilling all requirements in these Official Rules.
Entry Period: The Entry Period begins on January 10, 2024, at 12:00 AM ET and ends at 11:59 PM ET on January 26, 2024 (the “Entry Period”). Administrator’s computer is the official time-keeping device for the Sweepstakes.
How to Enter: Eligible Entrants may visit: 2024 Grey Goose Fly Away Sweepstakes during the Entry Period, complete the entry form, and follow the instructions to enter. Entrants will receive one (1) entry into the Grand Prize Drawing. There is a limit of one (1) entry per person. The use of multiple e-mail addresses, an agency, or any automated system to enter is strictly prohibited, and Sponsor reserves the right to disqualify any entries received through such methods. By entering, you indicate your full agreement to these Official Rules and Sponsor’s decisions regarding the Sweepstakes, which are final and binding.
Drawing: On or about January 29, 2024, Administrator will select one (1) potential winner in a random drawing of all entries received during the Entry Period. The odds of being selected depend on the number of eligible entries received. Administrator will attempt to contact the potential winner within five (5) business days of the drawing.
Potential Winner Requirements: Except where prohibited, a potential winner may be required to complete and return a declaration of eligibility and liability/publicity release. If a potential winner fails to sign and return these documents within five (5) business days, an alternate potential winner may be selected in his/her place in a random drawing of all remaining entries received, if time permits. Only three (3) alternate potential winners may be contacted.
Grand Prize:
One (1) grand prize winner will receive a trip for two (2) people to New Orleans to attend the Miami HEAT VS. New Orleans Pelicans game on February 23, 2024. The prize includes: (a) roundtrip coach-class airfare for two (2) people to New Orleans, Louisiana; (b) double-occupancy hotel accommodations for two (2) nights (February 23 and February 24); (c) two (2) premium tickets (within first ten rows, subject to availability) to the game with lounge access; (d) $200 towards ground transportation and (e) Grey Goose and Miami HEAT merchandise. Tickets are subject to availability, venue capacity, age, and other restrictions. The approximate retail value of the trip is $2,610 ($155 per game ticket, plus $500 per person airfare plus $300 per night hotel accommodations, plus $200 for ground transportation, plus $200 of Grey Goose merchandise, plus $300 in HEAT merchandise). The actual value may vary. Neither Sponsor nor the Miami Heat is responsible for, and winner will not receive, any difference between the actual value and ARV of any prize.
Once travel documents are issued, they cannot be changed. The guest must be at least twenty-one (21) years old and may be required to sign a liability and publicity release form prior to issuance of travel documents. The value of the prize will be treated as income to a winner, and the winner will be responsible for payment and reporting of all applicable taxes. The potential winner is responsible for paying taxes and any costs and expenses not specified above (including, without limitation, food and beverage, incidentals, facility fees, service charges or any other costs not expressly stated herein). Sweepstakes’ winnings will be reported to the Internal Revenue Service and winner can expect to receive a 1099 tax form for prizes which total more than $600.00 for the year. Failure to pick-up or use prize does not relieve winner of his/her tax obligations associated with acceptance of a prize. Any prize details not specified above will be determined by Sponsor, in its sole discretion. The grand prize may not be transferred prior to award. The potential winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion. No alcohol will be awarded as part of any prize. The Miami HEAT and the other Heat Released Parties (as defined below) are not responsible for lost, mutilated, undeliverable or stolen travel document(s) or game admission passes/tickets. None of the Heat Released Parties (as defined below) are responsible if the game is delayed, postponed, or cancelled for any reason, or for issues arising from the operation and management of the game. Winner may be required to provide a valid email address, download the applicable mobile ticketing app to his or her mobile device, and present tickets at the venue via mobile device. Data rates may apply. Winner is solely responsible for any such wireless or data charges associated with such use, including the downloading and use of mobile ticket app (if any). Travel and accommodations are subject to availability and change. Government restrictions and regulations, hotel, airline, airport or other transportation terminal (or other types of transportation) restrictions and regulations and other restrictions may apply. Sponsor assumes no responsibility for canceled, delayed, suspended or rescheduled events (including, but not limited to airline flights) or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies or any other persons providing any prize-related services or accommodations beyond its reasonable control. Selection of airline, flights, seating on flights and hotel are solely within Sponsor’s discretion. Winner will be required to provide a credit card prior to hotel check-in and is solely responsible for all incidental charges and may be required to sign an additional liability release for the use of the accommodations. Winner and guest must have all necessary identification and/or travel documents (e.g., a valid U.S. government issued ID, Real ID or passport) required for travel. The Miami HEAT is not responsible if the game is delayed, postponed, or cancelled for any reason, or for issues arising from the operation and management of the game.
General Conditions: In the event that the operation, security, or administration of the Sweepstakes is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the operation of the Sweepstakes, violates these Official Rules, or acts in an unsportsmanlike or disruptive manner. Sponsor reserves the right to seek damages from any person who seeks to undermine the legitimate operation of the Sweepstakes. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to the owner of an online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. The Sweepstakes is subject to federal, state, and local laws and regulations and is void where prohibited. The names of individuals, companies, products, and/or logos of the Miami HEAT are used for identification purposes only and are the intellectual property of its respective owners.
The Released Parties not responsible if the Sweepstakes cannot take place as planned, in whole or in part, or if the prize cannot be awarded, due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, pandemic, epidemic, government order, lockouts, other labor disputes, fire, acts of government, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or other events outside of the reasonable control of the Sponsor (each a “Force Majeure Event”). If the Sweepstakes cannot take place as planned, in whole or in part, or if the prize cannot be awarded due to a Force Majeure Event, or if a Force Majeure Event corrupts or affects the administration, security, fairness, or integrity of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes, the prize, or any portion thereof.
Release and Limitations of Liability: By entering, the potential winner(s) agree to release and hold harmless Sponsor, Administrator, Miami Heat Limited Partnership, Basketball Properties, Ltd., Kaseya Center, the NBA and its Member Teams, NBA Properties, Inc., NBA Media Ventures, LLC, Miami-Dade County, City of Miami (collectively, the “Heat Released Parties”), and each of their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, partners, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (g) injury or damage to persons or property. The potential winner(s) further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. The potential winner(s) waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Privacy and Publicity: By entering the Sweepstakes and voluntarily providing your personal information as described in these Official Rules, you agree to the collection and use of your personal information by the Released Parties for the purpose of administering the Sweepstakes, including, without limitation, contacting you with respect to the Sweepstakes, disclosing the name of the winner, and verifying your identity, eligibility, e-mail address, postal address, and/or telephone number. Any information submitted as part of the Sweepstakes will be treated in accordance with Sponsor’s Privacy Policy. Except where prohibited, participation in the Sweepstakes constitutes an entrant’s consent to Sponsor’s, Heat Released Parties’, and their agents’ use of his/her name, likeness, voice, opinions, biographical information, and state of residence for promotional purposes in any media without further payment or consideration.
Disputes: Winner(s) agree that any disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Miami, Florida. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the potential winner(s) rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Florida, without giving effect to any choice of law or conflict of law rules (whether of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Florida. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than entrant’s actual out-of-pocket expenses (i.e., evidenced costs associated with entering this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased.
Winner Information: For the name of the winner, send a self-addressed stamped envelope to Grey Goose Miami Heat Digital Sweepstakes – Winner List, P.O. Box 3509X, Grand Rapids, MN 55745-3509. Requests must be received by February 5, 2024.
